Welcome to Alira Flowers ("Alira Flowers", "we", "our", or "us").

These Terms & Conditions govern your access to and use of this website, as well as any commercial inquiries, quotations and business relationships initiated through Alira Flowers.

By accessing this website or engaging with our services, you acknowledge that you have read, understood and agreed to be bound by these Terms & Conditions.

1. Company Information

Alira Flowers is a commercial company based in Quito, Ecuador, dedicated to connecting international buyers with carefully selected Ecuadorian flower growers.

Our objective is to facilitate reliable business relationships and provide access to premium Ecuadorian flowers while promoting transparent and professional commercial practices.

2. Products

All products displayed on this website are subject to availability, harvest conditions, seasonal production and confirmation by the selected flower grower.

Product images are provided for illustrative purposes only. Due to the natural characteristics of fresh flowers, variations in color, size, bloom stage and appearance may occur.

3. Quotations

All quotations are prepared individually based on the customer's specific requirements.

Quoted prices may vary depending on, among other factors:

  • Product availability

  • Flower variety

  • Order volume

  • Packaging specifications

  • Seasonal conditions

  • Commercial requirements

Unless otherwise stated, quotations remain valid only for the period specified in the corresponding proposal.

4. Order Confirmation

Orders shall become binding only after written confirmation by the parties involved and verification of product availability by the selected flower grower.

Alira Flowers reserves the right to decline or modify any order prior to final confirmation.

5. Payment and Shipment

All orders shall be prepared and released for shipment only after full payment has been received and confirmed, unless different payment terms have been agreed upon in writing.

Shipment schedules are subject to product availability and operational conditions at the selected flower grower.

Failure to comply with the agreed payment terms may result in delays or cancellation of the order.

6. Commercial Intermediation

Alira Flowers acts exclusively as a commercial intermediary between international buyers and Ecuadorian flower growers.

Our role consists of identifying business opportunities, facilitating communication, coordinating commercial negotiations and assisting throughout the sourcing process.

Unless expressly agreed in writing, Alira Flowers does not act as:

  • Flower producer

  • Exporter of record

  • Freight forwarder

  • Customs broker

  • Carrier

  • Importer

  • Logistics operator

Responsibilities related to export documentation, transportation, customs clearance, import procedures, taxes, duties, insurance and destination-country regulations remain the responsibility of the corresponding parties involved in each transaction.

7. Claims, Returns and Commercial Credits

Due to the perishable nature of fresh flowers, all sales are considered final once the products have been dispatched.

No cash refunds shall be issued after shipment.

Any claim regarding quality, quantity or product condition must be submitted in writing within three (3) calendar days from the date the shipment is received.

Claims must include sufficient supporting evidence, including but not limited to:

  • Photographs

  • Videos

  • Packing information

  • Purchase documentation

  • Any additional information reasonably requested for investigation

Each claim will be reviewed together with the corresponding flower grower.

Where a claim is accepted, compensation shall be provided exclusively in the form of a commercial credit (Credit Note) applicable to future purchases.

The issuance of a Credit Note shall not constitute an admission of liability and remains subject to technical evaluation and approval.

Claims will not be accepted for damages resulting from:

  • Improper storage

  • Incorrect handling

  • Failure to maintain the cold chain

  • Delayed cargo collection

  • Improper transportation after delivery

  • Customer negligence

  • Events occurring after the products have been transferred to the carrier or buyer.

8. Force Majeure

Alira Flowers shall not be liable for any delay, interruption or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters

  • Severe weather conditions

  • Airport closures

  • Flight cancellations

  • Government restrictions

  • Labor disputes

  • Pandemics

  • Phytosanitary restrictions

  • Acts of war

  • Civil disturbances

  • Any other force majeure event affecting production or transportation.

9. Intellectual Property

All trademarks, logos, photographs, graphics, product descriptions, website content and other intellectual property displayed on this website are owned by or licensed to Alira Flowers.

No content may be reproduced, distributed or used without prior written authorization.

10. Limitation of Liability

To the fullest extent permitted by law, Alira Flowers shall not be liable for indirect, incidental, consequential or special damages arising from:

  • Transportation delays

  • Customs procedures

  • Airline operations

  • Grower performance

  • Product deterioration after transfer of risk

  • Third-party services

  • Business interruption

  • Loss of profits

Our liability shall, in all cases, be limited to the commercial intermediation services provided.

11. Privacy

Personal information collected through this website shall be processed in accordance with our Privacy Policy.

By using this website, users acknowledge and accept the terms of our Privacy Policy.

12. Amendments

Alira Flowers reserves the right to modify these Terms & Conditions at any time without prior notice.

Updated versions shall become effective immediately upon publication on this website.

13. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of Ecuador.

Any dispute arising out of or relating to these Terms & Conditions, the use of this website or any commercial relationship initiated through Alira Flowers shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Ecuador, unless otherwise required by mandatory applicable law.
